Athlete & Parent Waiver & Release of Liability

This Athlete & Parent Waiver, Release, and Assumption of Risk Agreement ("Waiver") is a legally binding contract between the participant named in the registration ("Athlete"), the parent or legal guardian ("Parent"), and the US Aerial Power Athletics Federation ("USAPAF").

This Waiver applies to all past, present, and future activities sponsored, organized, hosted, or sanctioned by USAPAF, including but not limited to competitions, training camps, exhibitions, trials, showcases, workshops, evaluations, classes, practices, performances, events, online activities, and travel associated with any of the foregoing (collectively "Activities").

Definitions

For purposes of this Waiver:

  • "Released Parties" includes USAPAF, its directors, officers, founders, members, coaches, trainers, judges, officials, volunteers, employees, contractors, agents, sponsors, affiliates, successors, assigns, and any other participants.
  • "Claims" includes any and all claims, demands, causes of action, lawsuits, damages, losses, liabilities, expenses, and attorney fees of any kind whatsoever, whether known or unknown, foreseen or unforeseen.
  • "Inherent Risks" includes all risks inherent in aerial athletics and related activities, including but not limited to falls, drops, collisions, equipment failure, rigging failure, apparatus malfunction, contact with apparatus, contact with other participants, overexertion, dehydration, heat illness, cold exposure, and injuries to any part of the body.

Acknowledgment of Risk

The Athlete and Parent acknowledge that aerial sports involve known and unknown risks that could result in:

  • Serious physical injury
  • Partial or permanent disability
  • Paralysis
  • Brain injury / traumatic brain injury
  • Concussion
  • Spinal cord injury
  • Broken bones
  • Internal injuries
  • Emotional or psychological trauma
  • Death

The Athlete and Parent acknowledge that these risks may result from the condition of equipment, facilities, training methods, coaching decisions, participant actions, environmental conditions, and unforeseeable circumstances.

Express Assumption of Risk

The Athlete and Parent voluntarily, knowingly, and freely accept and assume all Inherent Risks, both known and unknown, associated with participation in any USAPAF Activities, even if those risks arise from the negligence of the Released Parties.

Release and Waiver of Liability

To the fullest extent permitted by law, the Athlete and Parent hereby release, waive, discharge, and covenant not to sue the Released Parties from any and all Claims arising out of or related to participation in any Activities, including Claims based on negligence, gross negligence, premises liability, product liability, and any other theory of legal liability.

Waiver of Negligence

The Athlete and Parent expressly waive any claim based on the negligence of any Released Party, including but not limited to negligent supervision, negligent instruction, negligent training, negligent facility maintenance, negligent equipment inspection, negligent hiring, negligent retention, negligent emergency response, negligent medical clearance, or negligent failure to warn of risks.

Parent/Guardian Responsibilities

If the Athlete is a minor, the Parent signing this Waiver acknowledges that they have the legal authority to sign on behalf of the minor Athlete, and agrees that:

  • The Parent is legally responsible for the Athlete's actions and conduct.
  • The Parent has explained the risks of participation to the Athlete.
  • The Parent consents to the Athlete's participation.
  • The Parent agrees to be bound by all terms of this Waiver.
  • The Parent releases any Claims the minor Athlete may have.

Medical Consent

In the event of injury or illness, the Athlete and Parent authorize USAPAF to obtain emergency medical treatment and authorize medical providers to administer treatment.

The Athlete and Parent are solely responsible for all medical expenses incurred.

Medical Fitness Representation

The Athlete and Parent represent that the Athlete is physically fit, has no medical condition that would make participation unsafe, and has obtained any necessary medical clearance.

The Athlete and Parent agree to update USAPAF immediately in the event of any change in the Athlete's medical condition.

Indemnification

The Athlete and Parent agree to defend, indemnify, and hold harmless the Released Parties from any Claims arising from the Athlete's participation, actions, or omissions, including Claims brought by the Athlete, Parent, or any third party.

Binding Effect

This Waiver shall be binding upon the Athlete, Parent, heirs, next of kin, executors, administrators, personal representatives, and assigns.

Severability

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.

Waiver of Jury Trial / Class Action

Any dispute shall be resolved individually through binding arbitration. The Athlete and Parent waive any right to a jury trial or participation in a class action.

Governing Law

This Waiver shall be governed by the laws of the State of Illinois.

Acknowledgment

By signing, registering, submitting payment, or participating, the Athlete and Parent acknowledge that they have read this entire Waiver, understand its terms, understand that it is a legally binding contract, and agree to be bound by it voluntarily.
