This Membership Agreement governs the relationship between USAPAF and its members.
Effective Date: March 2026
This Membership Agreement ("Agreement") is entered into between the US Aerial Power Athletics Federation ("USAPAF") and the individual member, athlete, coach, judge, official, volunteer, parent, or legal guardian ("Member").
By applying for membership, renewing membership, submitting payment, participating in USAPAF activities, or accepting membership benefits, the Member agrees to be legally bound by this Agreement.
Membership in USAPAF is voluntary and may be granted, denied, suspended, restricted, revoked, or terminated at the sole discretion of USAPAF.
Membership does not create any ownership interest, employment relationship, partnership, agency relationship, or vested right.
Membership is a privilege and not a guaranteed right.
Membership fees are charged annually unless otherwise stated.
All membership fees are non-refundable, non-transferable, and non-creditable except where required by applicable law.
USAPAF reserves the right to change membership fees, benefits, classifications, and requirements at any time.
Members agree to:
USAPAF reserves the right to investigate and take disciplinary action regarding any conduct deemed inappropriate, unsafe, unethical, abusive, fraudulent, disruptive, harmful to the Federation, or inconsistent with its mission.

USAPAF decisions regarding disciplinary matters shall be final.
Membership does not guarantee:
All such decisions remain within the discretion of USAPAF.
All USAPAF names, logos, trademarks, certificates, rankings, event materials, membership materials, rules, publications, graphics, and content remain the exclusive property of USAPAF.
Members may not reproduce, sell, distribute, modify, or use Federation intellectual property without written authorization.
The Member grants USAPAF an irrevocable, perpetual, worldwide, royalty-free right to photograph, record, livestream, publish, reproduce, distribute, edit, display, and otherwise use the Member's name, image, likeness, voice, competition results, photographs, videos, interviews, and recordings for promotional, educational, commercial, historical, media, and Federation purposes without compensation.
The Member understands that participation in aerial athletics and related activities involves inherent risks including but not limited to:
The Member voluntarily assumes all known and unknown risks associated with participation.
The Member acknowledges that USAPAF does not provide medical treatment, medical supervision, medical advice, or health insurance coverage.
The Member is solely responsible for obtaining appropriate medical care, insurance coverage, and medical clearance for participation.
To the fullest extent permitted by law, the Member releases, waives, and forever discharges USAPAF and its directors, officers, founders, employees, contractors, volunteers, judges, officials, event organizers, sponsors, affiliates, representatives, and agents from any and all claims, demands, liabilities, damages, losses, costs, expenses, and causes of action arising from participation in any USAPAF activity.
The Member agrees to defend, indemnify, and hold harmless USAPAF from any claim, lawsuit, liability, damage, expense, or attorney fee arising from:
To the maximum extent permitted by law, USAPAF's total liability shall never exceed the total membership fees paid by the Member during the preceding twelve (12) months.
USAPAF shall not be liable for indirect, consequential, incidental, punitive, special, or exemplary damages.
Any dispute arising out of or relating to membership, participation, competitions, rankings, discipline, events, payments, or Federation activities shall be resolved exclusively through binding arbitration.
The Member waives any right to a jury trial.
The Member agrees that any claim must be brought individually and not as part of a class action, collective action, representative action, or consolidated proceeding.
This Agreement shall be governed by the laws of the State of Illinois.
This Agreement, together with the USAPAF Terms of Service, Privacy Policy, Competition Rules, and applicable Federation policies, constitutes the entire agreement between the parties.
By submitting a membership application, completing online registration, checking an acceptance box, signing electronically, submitting payment, or participating in Federation activities, the Member acknowledges that they have read, understood, and agreed to be legally bound by this Agreement.
